I think the complaint stems more from everyone using the exact same build that is bringing success; the players who refuse to switch are unpleased because it is a build that just about every monkey now has, and it is very difficult to counter, although possible. The problem, mainly, with countering is that you need to make your build in such a way that beating other builds is difficult. I use, for example, a support/tech TM build that works on every set up excluding strength mercenary, and the fact that this one build (that is now being wildly abused) is constantly ruining my day is the problem. So to answer the first question, it is not the build itself so much as the degree to which it is used. Were it a couple of players, it would be fine; I'm not going to win every battle. However, when I lose 6-7 battles in a row to the same build over and over, there is something wrong. Anyways, I think a smart build is a build that adapts to the situation, or a build that becomes progressively better the more capable a player the user of this build is. Builds such as 5 focus are examples of these because it takes a certain degree of skill to use them. Not every battle is alike. The better a player you are, the more devastating this class can be. Strength abuse is not an example of a smart build because no matter who you play, the strategy you're going to use is set in stone.
