I would say not too OP'd except the damage that is dealt with it can be decreased some. The amount of energy back is still less than an EMP. More or less its more like a static charge, with the ability to take it from someone. I have found no issues in beating tech mages with it in their line up. If they wanted to nerf it some, they could have it take 50% less energy from your opponent, but still replenish its same amount as current. Or just merely reduce the actual hit the move causes. Even before they upgraded it I always found bludgeon and Assimilate fun abilities to use in combination, why? Because at the time people expected a plasma bolt etc. I've also noticed that even being a blood mage currently I am still more likely to block assimilate, with the current focus 5 set ups, the assimilate stealing energy effect is not that potent of a move. Even with non upgraded starting energy at 35 it would take them several turns of using it to take my energy, and I can bot still, gun, aux, and regular hit, not to mention core abilities, and if in doubt as a blood mage I can reflex boost, which gives me extra block and energy if they do hit me. Against Tactical mercenary, assimilate is basically useless, they hit the Tact with assimilate take and give energy back to them. So I would say this move is not one that is in any big need to be downgraded.
