Hello guys, past few years I was improving my skills as a Game developer, Since it was done in my free time, I am still just okay-ish at it, but I really loved the game back in the day, I won't go into detail why I don't enjoy it anymore, but I was thinking.... Could I make (as the title says it) a game similar to epic duel ? It wouldn't be a blatant ripoff, or anything, just a game with features, that I personally believe are needed, and a lot of people also called out. Sure at first it would be small indie game with maybe one class, with small skill tree, and 20-50 items. But if people enjoy it I might expand. Anyways why I am writing this are for two core reasons

1. Would developers mind, sharing their intellectual property, by that I don't mean that they have to give me anything, besides permission to basically develop a really similar game. To be honest not sure how the entire legal system works, maybe if I make the game different enough, I don't need a permission ? Anyways, if there are any developers still active, would love to hear some feedback

2. If anyone wants to talk about this idea PM me.

Sorry if this isn't 100% up to forum standards, if it's not up to them, then to a mod that deletes this, could you at least send me a message where should I ask creators about copyright issues ? But seriously ask them a question, not just get bot to respond.

Such a topic can be a grey area, I will keep this here to inform you as well as others rather than delete it as it is important that people see it.

A developer or company cannot freely share their intellectual property with any individual when they feel like it. This is down to intellectual property protection and is there to stop people taking it from them (not saying this is the case, but so you know how it works).

Included in this protection are:

The names of your products or brands
Your inventions
The design or look of your products
Things you write, make or produce

Now, as for similar games that is all well and good. There are are plethora of similar games that are exist in harmony together. For example League of Legends and DoTA, very similar games but different ideas, different art, styles etc.

I'm not too clued up on the law side of things however but just what I have read up on.

I'll leave this open incase anyone needs to add input, either players or developers/mods etc.

Hey, thanks for the quick reply, well I am glad to know, that if I just make my own art/story/names I can make a game similar to this. I was always wondering, wouldn't a game like League of Legends infringe on Dota 2 Intellectual property, but I guess ideas can be the same. Digital X made a good post that covers most of what I'd have to say.

First, I applaud your efforts to pursue game development. It's a hard journey to make any game, and I wish you great luck and success in whatever you create. If you're concerned about copyright infringement, please note that nobody owns a genre (although some big companies have tried!), otherwise there would only be one battle royale game, and Sonic would not be allowed to exist. There are so many games that rip elements directly from Dark Souls that it became a new genre all its own. If you want to make a turn-based, PvP, RPG, go for it! There's plenty of room for more.

With all that said, I am not a lawyer. I can't give legal advice, but there are some obvious pitfalls that might get you in trouble:
Using art assets from EpicDuel and other AE games.
Using character names from EpicDuel and other AE games.
Parody can be a good shield against legal scrutiny, but things get dicey if you're monetizing that parody.
If you have a nearly complete project and you're unsure, talk to a lawyer. It's expensive, but it could save you from losing everything if you're violating copyright.

Your best defense is making sure the project is different enough that it won't be confused with EpicDuel.

Sometimes it can feel good and safe to make a project based on an existing property: Titan's project before EpicDuel was a Flash RPG called Quest that was very similar to AdventureQuest. However, working from this tight blueprint can be a trap that places excessive restrictions on your project and prevents it from transcending the source material. Filling your project with inside jokes and call-outs of EpicDuel could also limit your audience to other EpicDuel players and prevent it from establishing its own identity.

Don't underestimate the amount of work involved in creating a project like this. Tools for game development are better than every but it could still be a multi-year endeavor. I've seen similar projects created by players who wanted to make a bigger and better version of EpicDuel fizzle out due to scope creep, lack of planning, and lack of experience. Seek out a reliable team. You can probably do most of the work yourself, but having collaborators to share the workload will help you breeze through your timeline and help prevent burnout.
